Un ex soldado conscripto que hizo el servicio militar en 1977 y 1978, declaró en San Juan que sabía que los militares cometían ultrajes sexuales a las detenidas, entre ellas la modelo franco-argentina Marie Anne Erize, y que vio como golpeaban a detenidos a punto de ser trasladados a Buenos Aires.
El ex-soldado conscripto, también narró que en una oportunidad, una de las víctimas, una jovencita, le pidió que avisara a su casa lo que le pasaba: esa joven sería Margarita Camus, actual jueza de Ejecución Penal y querellante en el juicio por delitos de lesa humanidad que se sigue en San Juan, entonces militante peronista e hija del depuesto gobernador Eloy Camus.
El ex conscripto Octavio Tristán Echegaray, que hizo el servicio militar en el Regimiento 22 de Infantería de Montaña (RIM 22), con asiento en San Juan entre enero de 1977 y abril de 1978, incorporó su testimonio ante el Tribunal Oral Federal que juzga la represión ilegal en esta provincia, acercado por la abogada querellante María Julia Camus.
Según señaló Camus, Echegaray "aportó datos de mucho valor en la causa Erize", en referencia a la causa que investiga la desaparición de la modelo franco-argentina Marie Anne Eriz.
De acuerdo a lo informado por Camus, Echegaray el ex soldado le dijo a los jueces Héctor Cortés, Raul Fourcade y Alejandro Piña, que era vox populi entre los soldados del RIM 22, que los oficiales habían abusado sexualmente de una detenida joven y hermosa.
La querellante dijo que Echegaray declaró luego de muchos años, cuando, tras leer artículos periodísticos investigaciones periodísticas, relacionó ese comentario con la "desaparición" de Erize.
Marie Anne, que había sido modelo publicitaria y había aparecido en varias tapas de revistas de la época antes de dedicarse a la militancia social, tenía un novio montonero y fue secuestrada el 15 de octubre de 1976 en la Bicicletería Palacios.
Según destacó Camus, los abusos sexuales y las violaciones formaron parte del repertorio de habitual de tormentos que pusieron en práctica los represores contra las mujeres. La abogada precisó al respecto que en este mismo juicio hay 5 víctimas que denunciaron haber sufrido ataques sexuales, aunque no pudieron señalar a ninguno de los sospechosos juzgados, debido a que durante los "interrogatorios" se encontraban encapuchadas o con los ojos vendados.
Los acusados son el mayor (R) Jorge Olivera, el capitán (R) Gustavo De Marchi, y el teniente coronel (R) Juan Francisco del Torchio, todos los cuáles eran entonces tenientes, los suboficiales Alejandro Benito Martel, Antonio Lazo y Daniel Gómez y el ex jefe de la Delagación de la Policía Federal, comisario Horacio Nieto.
El proceso todavía tiene como prófugos al teniente coronel (R) Carlos Luis Malatto, cuya extradición a Italia se ha pedido, el mayor (R) Eduardo Daniel Vic, el coronel (R) Eduardo Daniel Cardozo, el capitán (R) Jorge Horacio Paéz, y el ex jefe de la Policía de San Juan, coronel (R) Juan Carlos Coronel.
Echegaray también señaló que participó de un procedimiento de traslado de presos desde el Penal de Chimbas hacia el aeropuerto Las Chacritas y relató la feroz paliza que los detenidos sufrieron.
De acuerdo a Camus, Echegaray dijo que cuando entregaron a los detenidos a los uniformados que venían en el avión, vio que les dieron una pateadura impresionante, y que les pegaban con las culatas de las armas, algo que describió como "desgarrador".
La abogada también señaló que en esa situación le tocó custodiar a una chica que lo reconoció y que le dijo: `Avisá en mi casa´ y que esa joven había sido su hermana Margarita Camus, entonces militante de la Juventud Peronista y hoy jueza de Ejecución Penal y querellante en el juicio por delitos de lesa humanidad que se sigue en San Juan.
Es de hacer notar que otro "colimba" que hizo el servicio militar con la clase anterior a la de Echegaray, Jorge Alberto Bonil, fue declarado "desertor" y desaparecido el 28 de febrero de 1977, cuando le quedaban pocos días para terminar su servicio militar.
Antes de desaparecer, Bonil, que era militante de la Juventud Peronista pero al que los militares consideraban haber "dado vuelta" y que trabajaba en el sector de inteligencia, dijo en una que los tenientres Olivera y Cardozo se jactaban de haber violado a "la francesita".
